APPEALS PROCESS

YOU ARE NOT ALONE!
Success rates for first-time claims can be as low as 20%.
There are 3 levels of appeal freely available for those who feel they have been incorrectly assessed.
The following factsheet explains the DSP appeals process, including each stage of review and appeal.
Continue below for key steps.
KEY POINTS & STEPS
1. GET A COPY OF THE ASSESSMENT
If your claim has been rejected, request a copy of the assessment before or when you request a review. The assessment explains why your claim was rejected and can help you identify what needs to be addressed.
You can use the assessment to:
- Identify issues that may be corrected with further evidence.
- Provide evidence that a factual error has been made.
- Identify legislation or requirements that may have been overlooked or incorrectly applied.
You can request a copy in person, by phone, or using the link below.
2. GATHER NEW EVIDENCE
At this stage, it is important to remember that the assessment generally focuses on whether you met the eligibility requirements at the time of your claim and during the relevant 13-week period.
New medical evidence should therefore clearly explain how your condition, impairment and functional limitations applied during that period. If a report only describes your circumstances from the date it was written, it may have limited relevance to your claim or appeal.
3. CONSIDER REAPPLYING
Once you have obtained evidence addressing the reasons for rejection, you may be able to lodge a new DSP claim while continuing with your review or appeal.
This can be particularly worth considering if your internal review is unsuccessful and you are proceeding to the Administrative Review Tribunal (ART), although it may also be appropriate earlier depending on your circumstances.
4. ADMINISTRATIVE REVIEW TRIBUNAL (ART)
If your internal review is unsuccessful, you can request a further review by the Administrative Review Tribunal (ART) using the link below.
